Welcome to Xugiso. These Terms and Conditions govern your use of our outdoor event services and website. By engaging our services or using our website, you agree to be bound by these terms.

1. Definitions and Interpretation

In these Terms and Conditions, unless the context otherwise requires:

  • "Company" refers to Xugiso, registered at 14 Elmfield Road, London, SW17 8AD.
  • "Client" means any individual or organization engaging our outdoor event services.
  • "Event" refers to any outdoor gathering, activity, or function organized by the Company on behalf of the Client.
  • "Services" means the outdoor event planning, coordination, and execution services provided by Xugiso.
  • "Website" refers to all pages and content accessible through our online platform.

2. Service Provision

2.1 Scope of Services

Xugiso specializes in organizing and conducting outdoor events, including but not limited to corporate team-building activities, outdoor celebrations, adventure experiences, and recreational gatherings. The specific services provided will be detailed in the individual service agreement or booking confirmation.

2.2 Service Customization

We work closely with clients to customize events according to their requirements. All customization requests must be submitted in writing and are subject to feasibility assessment and additional charges where applicable.

3. Booking and Payment Terms

3.1 Booking Process

To secure a booking, clients must complete our booking form and pay the required deposit. Bookings are confirmed only upon receipt of the deposit payment and written confirmation from Xugiso.

3.2 Payment Schedule

  • A non-refundable deposit of 30% is required at the time of booking
  • The remaining balance must be paid no later than 14 days before the event date
  • Failure to make timely payments may result in cancellation of the booking

3.3 Accepted Payment Methods

We accept bank transfers, credit cards, and other payment methods as specified during the booking process. All payments must be made in GBP unless otherwise agreed in writing.

4. Cancellation and Refund Policy

4.1 Cancellation by Client

  • More than 30 days before the event: 70% refund of total amount paid
  • 15-30 days before the event: 40% refund of total amount paid
  • Less than 15 days before the event: No refund
  • The initial deposit is non-refundable under all circumstances

4.2 Cancellation by Xugiso

In the unlikely event that we must cancel your event due to circumstances within our control, you will receive a full refund or the option to reschedule to an alternative date at no additional cost.

5. Weather and Force Majeure

5.1 Weather-Related Changes

As outdoor event specialists, we monitor weather conditions closely. If weather conditions pose a safety risk, we reserve the right to modify, postpone, or relocate the event. In such cases, we will work with you to find a suitable alternative date or indoor venue where possible.

5.2 Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, government restrictions, pandemics, or other force majeure events. In such cases, we will offer rescheduling options or a pro-rata refund.

6. Client Responsibilities

6.1 Accurate Information

Clients must provide accurate information regarding participant numbers, special requirements, dietary restrictions, medical conditions, and any other relevant details that may affect event planning and execution.

6.2 Participant Conduct

Clients are responsible for ensuring that all event participants behave appropriately and follow safety instructions provided by Xugiso staff. We reserve the right to exclude any participant whose behavior poses a risk to themselves or others.

6.3 Equipment and Property

Clients are responsible for any damage to equipment or property caused by participants during the event. Additional charges may apply for repairs or replacements.

7. Liability and Insurance

7.1 Our Liability

Xugiso carries comprehensive public liability insurance for all events. However, our liability is limited to direct damages caused by our negligence. We are not liable for indirect, consequential, or special damages.

7.2 Participant Safety

While we take all reasonable precautions to ensure participant safety, outdoor activities carry inherent risks. Participants engage in activities at their own risk, and we recommend that clients ensure participants have appropriate personal insurance coverage.

7.3 Medical Conditions

Clients must inform us of any medical conditions, disabilities, or special needs of participants that may affect their participation in activities. Failure to disclose such information may void our liability.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Xugiso and protected by copyright laws. Unauthorized use, reproduction, or distribution of our content is strictly prohibited.

Photographs and videos taken during events may be used by Xugiso for marketing purposes unless the client explicitly requests otherwise in writing.

9. Privacy and Data Protection

We are committed to protecting your privacy and handling your personal data in accordance with applicable data protection laws. Personal information collected during the booking process is used solely for event organization and service delivery. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.

10. Modifications to Services

Xugiso reserves the right to make reasonable modifications to event programs, activities, or venues when necessary due to operational requirements, safety concerns, or circumstances beyond our control. We will inform clients of any significant changes as soon as possible.

11. Complaints and Disputes

11.1 Complaint Procedure

If you have any concerns or complaints about our services, please contact us immediately. We are committed to resolving issues promptly and fairly. All complaints should be submitted in writing to [email protected] within 7 days of the event.

11.2 Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through good-faith negotiation before pursuing legal action. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. By using our services, you agree to submit to the exclusive jurisdiction of the English courts.

13. Changes to Terms and Conditions

Xugiso reserves the right to update or modify these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
